This paper examines the lawsuits brought by state and local government entities against prescription opioid producers and sellers. It examines their potential liability as well as some of the defenses they might raise. The paper also discusses multidistrict litigation and government lawsuits in state court. It concludes that litigation is not the best solution to the opioid crisis.

In Protestant theology, the law of the Old Testament still has two functions for Christians: as God’s containment of the chaos in the form of political order and as confronting self-righteous humans in their inability to comply and pointing them to the necessity of grace. For Reformed Protestants however, there is a third use of the law, directed to the renatus, the ‘born again’ Christian, to the iustus and not to the peccator in order for him to keep growing in (...) insight and the practice of God’s will. Different from the Lutheran usus politicus, it is not limited to being God’s containment of evil through the orders of creation, but the realisation of and the public responsibility for those possibilities of life that were disclosed for men/women as partners in God’s covenant by God’s law. Croatia is a transitional society in that it is a country emerging from a socialist command economy toward a market-based economy with ensuing structural changes of a social and political nature—some extending into the healthcare system. A legacy from our past is that, until now, Croatian healthcare institutions have had no real experience with clinical ethics support services. When clinical cases arise presenting complex ethical dilemmas in treatment options, the challenges presented to the medical team are substantial. The case described (...) below recently occurred on a ward in a university hospital in Croatia. An unexpected request from the patient’s parents created a number of issues that needed to be addressed by the medical team, which was made more difficult by the lack of clinical ethics support services. Such cases press the question currently being debated as to what type of ethics support services would be suitable for Croatia and why. (shrink)

El objetivo de este trabajo es mostrar la influencia socrática sobre la filosofía de Euclides de Mégara, en contra de la interpretación que señala la influencia de los eleáticos sobre su teoría. Para ello indicaré que la doctrina de Euclides exhibe una fuerte impronta socrática, al menos en lo que concierne a: su labor como escritor de diálogos socráticos, el uso de la dialéctica erística, el desarrollo de algunos postulados éticos sobre la conducta frente a la muerte, el auto-dominio y (...) la unidad de la virtud, y la presentación de una metafísica que coloca al bien en un lugar privilegiado. Aunque esta metafísica excede el socratismo, no puede ser identificada con los postulados de la filosofía eleática. (shrink)

This paper is a demonstration of an application of Semiotic Textology to a limited case study. The main aspects of Semiotic Textology, the theory elaborated by Petöfi, are presented; secondly the linguistic aspects of the interpretation of lines 133–134 of the Theognis of Megara’s poem, analysed in the framework of said theory, are presented. All the relevant syntactic, semantic, pragmatic information involved in text processing have been considered. Through fixed steps, it is shown that text processing is not exclusively (...) a grammatical activity, because within a theoretical interpretation an Interpreter needs a number of contextual hypotheses, in order to understand the author’s ontology. It is immediately evident that the second sentence in this passage is incomplete; as it stands is fails to tell us what it was that Dieuchidas said execept in so far as it implies some connexion between either Solon of Peisistratus and the lines which we now reat at Iliad 2.558 ff. Many scholars have striven to fill the lacuna in accordance with their own views of what Dieuchidas ought to have written, and some have sought to use the resulting (...) text as a substantive argument for Dieuchidas' knowledge of the so-called ‘Peisistratean recension’. Pretendemos neste artigo apresentar uma aproximação crítica com relação à filosofia desenvolvida pelos chamados megáricos, em face sobretudo da figura de Euclides de Mégara como representante e líder dessa linhagem de pensamento. O enfoque será feito tendo em vista o tipo de filosofia exposta e praticada por Euclides, a partir das acusações que contra ela se fizeram denunciando-a como pura erística, ou seja, a disputa e o debate entre discursos com o único objetivo de obter vitória na argumentação. O que (...) se constata em Euclides é a defesa da prática do debate com a finalidade de mostrar que o discurso é incapaz de dar conta da realidade, de um modo geral, e assim impossível de determinar, de um modo específico, o Ser e a Unidade que são a essência daquilo que organiza e move todas as coisas. Essa essência de ordem é desejável por ser boa, e o Bem se apresenta, assim, como fundamento da realidade. Os estudos sobre a tradição megárica dividem-se entre a influência dos eleatas e a influência de Sócrates. Faremos, desse modo, a defesa de que a filosofia de Euclides está afinada com o socratismo, conjugando de um modo exemplar aquilo que os eleatas haviam definido em relação ao Ser. (shrink)

The testimonies of Stilpo of Megara show an anti-Platonic position within the megaric program against fundationists attempts. This paper studies a particular point of this deployment. We will review the origin of the views that locate thruth on the onomastic or on the predicative level. This initial survey will provide the basis for the study of the paradoxes of the nomination, an element Stilpo used as a tool to challenge the theory of Forms, and the analysis of the aporias (...) of predication, through which he rejects the combination of parts of the sentence in order to represent reality. The figure of Stilpo reveals the dialogical context in which ancient philosophies developed and, at the same time, displays ways of thinking the relationship between language and reality often forgotten. In this “Letter from Chile” I describe and comment the main features of philosophical activity in Chile. My perspective is related to my own academic experience: that of a Chilean academic, who earned his doctorate at the Free University of Berlin, worked in that same university for six years as an Assistant Professor, and has been an Associate Professor at the Department of Philosophy at the Pontificia Universidad Católica de Chile in Santiago for the last eleven years. The first part (...) of the text offers a review of the historical development of philosophy in Chile. Afterwards, I refer to the current situation of our academic philosophy, analyzing various aspects: issues, currents, institutions, publications, research system, among others. Finally, I outline, from the above, some assessments and a general diagnosis of the present situation of philosophy in my country. (shrink)

Die Ausgangsthese des Beitrags lautet: Die Phänomenologie ist wesentlich pragmatisch und der Pragmatismus ist im Grunde phänomenologisch, so dass man vom,phänomenologischen Pragmatismus‘ reden kann. Durch diese Idee könnte man auch über das Wesentliche der phänomenologischen sowie auch der pragmatisch bzw. pragmatistischen Denkungsart erneut nachdenken. In der ersten Hälfte wird versucht, diese Idee anhand einiger aristotelischen Gedanken zu belegen. In der zweiten Hälfte handelt es sich um die Eröffnung der Perspektive dieser Idee für das philosophische Denken. Als ein konkreter Ansatzpunkt gilt (...) das Thema,Geschichtsdenken‘. Dieser Ansatzpunkt ist kein bloßer Einfall. Denn er trägt dazu bei, wenn er sachgemäß bearbeitet wird, das Wesentliche der Phänomenologie und des Pragmatismus zum beleuchten. Dazu sei zu bemerken, dass in der Phänomenologie und im Pragmatismus das Geschichtsdenken überhaupt eher zurückgeblieben als entwickelt war. Dies war kein Zufall, da das, worum es im Geschichtsdenken geht, in der gewöhnlichen Vorstellung das ist,,was geschehen ist‘, während das,phainomenon‘ in der Phänomenologie durchaus Gegenwartserlebnis sein soll. Wie man das Geschichtsphänomen als,phainomenon‘ der Gegenwart auffassen kann, ist eine phänomenologisch-pragmatisch provokative Frage. Der Schlüssel dieser Frage wird im vorliegenden Beitrag in der,reinen Erfahrung‘ gesehen, die von W. James vorgeschlagen und vom japanischen Philosophen K. Nishida weiter bearbeitet wurde. (shrink)

The Lycian elite were heavily ethnos-oriented in their political activities and marriage policy. Social relations with members of the elite in other provinces were seldom established. The two siblings Claudia Iasonis and Tib. Claudius Agrippinus of Patara are an exception in this respect. Agrippinus acted as benefactor beyond the borders of his province and received honours by the koinon of Asia. His sister Claudia Iasonis married a man from Asia and attained the post of Asiarch. Social contact with the provincial (...) elite of Asia appears to have been established via the Pergamenian Iulius Quadratus, legate of Lycia-Pamphylia in ca. 90-92 A. D. About two decades later Claudia Iasonis seems to have persuaded the Pergamenian magnate to support Heliodoros of Lydai in obtaining the Roman citizenship. An honorary inscription from the agora of Lydai published here in first edition is so far the only testament to this woman’s activities. (shrink)

Proceeding from the thesis of Remi Bragues, that Europe constantly attains its identity in contras and via delimitation, this article describes the Catholic and Protestant concept of Europe which was developed in the 19th century: Both agree in the rejection of Enlightenment ideals, and yet pursue different interests: While the Catholic line strives toward integration by means of the Church, Protestantism relies upon the nation state. These two lines can be understood as blueprints of current controversies: How is the relationship (...) between the nation state and the European Union to be determined? Does Europe need a unifying basis of values? Finally, the article makes a case for integration by means of seeking a common law which is open to different national and worldview traditions, and for seeing the independent profile of Europe in such secular law. Drei wichtige Manuskripte aus dem Nachlass von Richard Schaeffler - er lebte von 1926 bis 2019 - versammelt dieses Buch, ergänzt um eine Reflexion zur Theodizee und vier Beiträgen des Herausgebers über Leben und Werk des bedeutenden Philosophen. Die bisher unbekannten, autobiographisch geprägten Texte Schaefflers, die er kurz vor seinem Tod dem Herausgeber für eine spätere Veröffentlichung überließ, erscheinen hier erstmals. Bei näherem Hinsehen zeigt sich, dass Denken und Leben bei Schaeffler zu einer Einheit verschmelzen: Durch Lebenserfahrung angestoßen, eröffnet uns (...) das Denken die Möglichkeit einer Versöhnung mit der eigenen Lebensgeschichte. Das gilt in besonderer Weise für die Erfahrung von Leid, die Schaefflers Leben vor allem in der Jugend - als Halbjude in der Zeit des Nationalsozialismus - und im Alter - angesichts von Krankheit und Siechtum - prägte. Wie kann Philosophie mit Leiden und Endlichkeit umgehen, ohne der Verzweiflung zu verfallen? Dem Leser gibt Schaeffler Zeugnis von seiner Selbstverständigung als Wissenschaftler: dass nämlich Philosophie nur dort ihren Namen verdient, wo sie nicht in der weltentrückten Beschaulichkeit eines Gelehrtenzimmers betrieben wird, sondern - als Lebensform eingeübt und erprobt - ihren Ausgang nimmt in den eigenen (Leid-) Erfahrungen - der Erfahrung bedrängender menschlicher Endlichkeit. Das Leben ist der Prüfstein des Denkens. Der Herausgeber Christoph Böhr ist ao. Professor für Philosophie an der Hochschule Heiligenkreuz/Wien und leitet dort die Forschungsstelle für Metaphysik.
